Dishonorable discharge is a bar to the benefits

Obtaining VA benefits after the dishonorable discharge of a service member is not as simple as it seems. The Department of Veterans Affairs (VA) proposes a new rule that would alter the process of discharge from military. The idea is to change the definition of discharge regulations to make them more understandable. Particularly, the proposed rule seeks to include the “compelling circumstances” exception to three existing barred benefits of the regulations. It will also restructure some of the existing regulations to more clearly define what actions are considered dishonorable.

The regulations will include a brand new paragraph (d(2)), which will clarify the regulatory barriers to benefits. The new paragraph will incorporate a new format to analyze compelling circumstances. It will replace the expression “Acceptance of substitute in place of trial” with an explicit description, namely, “acceptance of discharge under other than acceptable conditions”.

The proposal also proposes an exception for those who are insane. This exception will be applicable to former service members who were found to be insane at the time of the incident. It can also be applied to resignation and an offense that results in a court-martial.

The AQ95 Proposed Rules are currently open for public comments. Comments are due by September 8th 20th, 2020. The changes were criticized by Harvard Law School’s Legal Services Center.
