The ADA and Veterans Disability Legal Rights

If you’re a veteran or run a business for disabled people it’s crucial to understand that the ADA prohibits discrimination based on the basis of disability. As a result, you should make sure that you’re not dissuading veterans from hiring you, or from bringing a claim for disability benefits for veterans.

Obesity does not qualify for VA service connection.

Contrary to what many people believe, obesity is not an impairment for which the VA offers service connection. This is a misconception that is caused by a failure to know the legal definition of obesity.

Obesity is a condition resulting from a health condition that is a hormonal and metabolic disorder. It increases the risk of developing a variety of diseases and cause functional impairment in earning capacity. A VA Rater will assess the severity of the symptoms and then determine the appropriate disability rating.

In the past the BVA has recited the old fashioned argument that obesity alone is not a disability. In Hunt v. Shulkin (2010), the Federal Circuit reiterated this reasoning. However the court did, however, not declare that all obesity claims must be service connected.

Walsh Walsh. United States dealt with a claim for “secondary connection” involving obesity. Although the decision did not directly address the issue however, it was a useful piece of information for Veterans who were seeking a secondary service connection.

The “Walsh” opinion is an excellent resource for Veterans who are seeking a secondary service connection for a variety of conditions. The opinion does not address obesity however, it does offer useful advice.

Using the example of a veteran suffering from DMS and who is also gaining weight in the process, the Walsh opinion states that the “aggravation” of a non-service-connected disability could be a step in the chain of causality. The nexus of DMS and obesity may be as significant as the nexus between hypertension and obesity.

The GG Opinion does NOT include the term “aggravation”. This is because the VA aggravation rule would be incompatible with absence of the term.

Although the Federal Circuit didn’t decide that obesity is a condition for which the VA will grant service connections for, it did confirm that Walsh’s decision was a valuable reference. The decision was a good one, and it is crucial for Veterans to note that it is the first time that a court has recognized that a worsening of an obesity condition can be a factor in creating a service connection.
