Armstrong World Industries Asbestos Trust

The asbestos-containing products of Armstrong were extensively used in commercial, residential, as well as military construction industries. Many Armstrong workers were exposed to asbestos, resulting in asbestos-related diseases.

Celotex Asbestos Trust
In the early and mid 1980s, Celotex Corporation, a manufacturer and distributor of building materials, faced numerous lawsuits alleging asbestos-related property damage. These claims, as well as others claims, demanded billions of dollars in damages.
Celotex filed for bankruptcy protection in 1990. The reorganization plan that it had created created the Asbestos Settlement Trust to process asbestos related claims. The Trust submitted a claim to the United States District Court for Middle District of Florida. It was represented by lawyers from Saiber L.L.C.
The trust applied for protection under two policies of comprehensive excess general liability insurance. One policy offered five million dollars of coverage while the other provided 6.6 million. The Celotex Asbestos Trust filed proofs of bodily injury claims on December 31st in 2004. The trust also filed a motion to rescind the special master’s determination.
Celotex had less than $7 million of primary coverage when it filedfor bankruptcy, but they believed that asbestos litigation in the future would affect its coverage. In fact, the firm foresaw the need for numerous layers of extra insurance coverage. The bankruptcy court did not find any evidence to suggest that Celotex provided a reasonable notice to its excess insurers.
